The Coming Farting Cows Tax versus a Tax Credit for Dead Cockroaches

Many years ago a scientist (I had my suspicions he might have been a mad scientist), who has since passed away, hired me to help him identify stocks that would decline in price in the event of a global cooling. I have forgotten a lot of the details of why he expected a global cooling instead of a warming, but I do remember him telling me that cows and cockroaches emitted significant quantities of greenhouse gas emissions through, well, farting.

This all comes to mind because Drudge is linking to a story about the EPA considering a tax on the owners of farting cows (and they all fart):

Dwindling government coffers and Silicon Valley wealth have led the Internal Revenue Service to add auditing attorneys to its local estate tax division.

Kyle Martin, an IRS supervisory estate tax attorney, told the Silicon Valley Bar Association that his office had hired 14 nonpermanent attorneys on a one-year program which has tax attorneys thinking there will be an increase in estate tax audits.

7th Circuit Federal Court of Appeals Hears Landmark 16th Amendment (Income Tax) Case

William J. Benson was charged with falsely telling the American people the 16th Amendment was not ratified and therefore the income tax is unconstitutional. The evidence of the truth of his statement was struck from the record as "irrelevant and immaterial." The appeal before the 7th Circuit raises the question of whether American citizens will continue to be allowed to prove their innocence in the courts of this country.

Webmaster's Commentary: 

Take a closer look at that one. Benson is charged with falsely claiming that the 16th Amendment was never ratified, then the court declares any and all proof that might vindicate him as "irrelevant and immaterial."

This is, of course, the logical outcome of a court system which is itself funded by tax dollars. There is a clear conflict of interest which precludes justice being done in this case.

The government's attitude towards the 16th is that it no longer matters if it was really ratified or not, the tax system depends on it, therefore by fiat is is legal. Judge James C. Fox, in Sullivan Versus United States, admits right in the court record that examination shows that the 16th Amendment was not actually ratified, then goes on to say that since the nation has acted as if it was ratified all this time, there is no reason to change things at this late date. This is akin to saying that if a man get away with a murder for, let us say, twenty years, there is no reason to go back and prosecute him even if the evidence proves his guilt.

MONTGOMERY, Ala. – For farmers, this stinks: Belching and gaseous cows and hogs could start costing them money if a federal proposal to charge fees for air-polluting animals becomes law.

President-elect Barack Obama may consider delaying a campaign promise - to roll back tax cuts on high-income Americans - as part of his economic recovery strategy, two aides said on Sunday.

At first read, this article will probably piss you off. Not even in office and already Obama is caving on his campaign promises.

BUT, note that nowhere in this article is there a statement by Obama himself. So, one of two things is oging on.

1. Obama's advisers are simply putting out their own agenda, hoping to create a public expectation of what Obama will do in office, in order to coerce certain policies upon him; to box him in politically. If that is the case then Obama needs to get his people back under control.

2. Obama is using his advisers to float some trial balloons to see what campaign promises he can drop without losing his huge margin of support coming out of the election. If this is true, then Obama has just betrayed a fatal weakness! He thinks America voted for him. personally. We did not. We voted AGAINST continuing the policies of the past that got us into this mess, and we expect and demand change with this new administration.

So far, Obama is looking more and more like business as usual, and if indeed Obama simply picks up where Bush leaves off Obama will quickly find that the frustration and pent-up anger currently focused on Bush will quite easily transfer onto himself.

Why don't McCain's tax returns report gambling revenue?

Gambling has tax implications. According to IRS Publication 17, "Your Federal Income Tax", 2007 edition, page 89 "Gambling Winnings. You must include your gambling winnings in income on Form 1040, line 21. If you itemize your deductions on Schedule A (Form 1040), you can deduct gambling losses you had during the year, but only up to the amount of your winnings." In other words, you can't subtract your losses from your winnings and just not report. You have to report the winnings, and then claim the losses.

But McCain's tax returns say nothing about gambling winnings or losses.

The problem is not the volunteers; it's the complexities of the tax code. We used to have a supposedly top tax firm do our taxes here in Hawaii, and this year we found out that they missed a major deduction we were entitled to for the last 9 years running. That cost us a huge amount of money, and IRS rules say we can only refile for the last 2 years on this.

So, even the pros are confused by this tax code mess.

You know, if the taxes were meant to be fair to all people, the tax code would fit in as pamphlet, but the volumes and volumes of tax code consist of nothing but special tax favors to favored cronies that allow them to shift the tax burdens onto someone else, like that stupid wooden arrow tax exemption slipped into the bailout bill.
